These Terms of Service (“Terms”) govern your access to and use of the whyshoot? website and services (the “Platform”). By using the Platform, creating an account, or submitting a brief, you agree to these Terms. If you are using the Platform for an organisation, you confirm you are authorised to accept these Terms on its behalf. If you do not agree, please do not use the Platform.
whyshoot? (“whyshoot?”, “we”, “us”, “our”) is an AI campaign-production platform and ethical model marketplace. We connect brands with real and AI (synthetic) models and produce campaign imagery from the products and briefs you supply. You can reach us at hello@whyshoot.in.
You must be at least 18 years old to use the Platform, create an account, or apply as a model. By using the Platform you represent that you meet this requirement and that the information you provide is accurate and current.
Some features require an account (for brands and for models). You are responsible for the activity under your account and for keeping your credentials secure. Notify us promptly of any unauthorised use. We may suspend or close accounts that breach these Terms or that we reasonably believe are being used unlawfully.
You may browse the roster, submit briefs, apply as a model, and contact us. You agree to use the Platform lawfully and not to: misuse, disrupt, or attempt to gain unauthorised access to the Platform; copy, scrape, or resell content; upload malicious code; or infringe anyone’s rights. We may add, change, or remove features at any time.
Every real model’s likeness is used only under the consent and usage boundaries the model has agreed to, as described on our Licensing & consent page. Models choose the categories they are comfortable with and may withdraw consent for future use. AI (synthetic) models are fully computer-generated and are labelled as such. You may not use any likeness or delivered image outside the rights granted for your specific project, and you may not use content in a way a model has opted out of.
Parts of our imagery are produced or enhanced using artificial intelligence. AI models are synthetic and do not depict real individuals. You are responsible for ensuring your use of any delivered image complies with applicable advertising, disclosure, and consumer-protection laws in the markets where you publish.
Project scope, timelines, revisions, and deliverables are agreed per engagement. Submitting a brief is a request, not a binding order; an engagement begins when we confirm it. You are responsible for having the rights to any product images, brand assets, or materials you provide to us.
Commercial terms — including pricing, credits, and payment schedule — are provided to you directly for each engagement and form part of your agreement with us. Unless stated otherwise, fees are exclusive of applicable taxes, which you are responsible for. Payments made are non-refundable except as required by law or as expressly agreed.
The whyshoot? name, website, software, and systems, and all associated intellectual property, belong to us or our licensors. Rights in delivered images are licensed to you for the uses set out in your project agreement; we retain ownership of underlying models, tools, and pre-existing materials. You grant us a limited licence to use materials you submit solely to provide the services and, where you permit, to showcase completed work.
You agree not to request, create, or use content that is unlawful, defamatory, deceptive, discriminatory, sexually explicit involving any real person without consent, or that violates a model’s agreed usage boundaries or a third party’s rights. We may decline or remove any request or content at our discretion.
The Platform is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or that results will meet every expectation. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
To the fullest extent permitted by law, whyshoot? will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill. Our total aggregate liability arising out of or relating to the Platform or an engagement will not exceed the amount you paid to us for the engagement giving rise to the claim in the three (3) months before the event.
You agree to indemnify and hold whyshoot? harmless from claims, losses, and expenses arising from your misuse of the Platform, your breach of these Terms, or your use of delivered images outside the rights granted, including any materials you supplied to us.
You may stop using the Platform at any time. We may suspend or terminate access if you breach these Terms or where required by law. Provisions that by their nature should survive termination (including IP, disclaimers, limitation of liability, and indemnity) will survive.
Our handling of personal data is described in our Privacy Policy, which forms part of these Terms.
These Terms are governed by the laws of India. Subject to applicable law, the courts at our principal place of business in India will have jurisdiction over any dispute, and the parties will first attempt to resolve disputes amicably in good faith.
We may update these Terms as the Platform evolves. We will revise the “Effective date” above and, for material changes, take reasonable steps to notify account holders. Continued use after changes take effect constitutes acceptance.
